11. The learned advocate has also relied upon the Division Bench judgment of this Court in the case of Mulchand Sobhrajmal Ganvani v. The Secretary to the Government of Gujarat and Ors. reported in 1991 (1) GLR 421, particularly para 3 at page 422, this Court has referred to earlier judgment of the Hon'ble Apex Court in the case of Smt. Dharmista Bhagat (supra) as observed as under:
