10. The matter is remitted back to the Civil Judge, Sr. Division-II,
Civil Court, Seraikella Kharsawan to decide afresh in the light of the
observation made by the Hon'ble Supreme Court in case of "Chandra
Bhan" (supra) after providing opportunity of hearing to the parties. It is
made clear that the amount which has already been paid to the appellants
shall not be recovered from the appellants.
