As mentioned earlier, it is not necessary for me to burden this Judgment with the wider question as to whether the view taken by the Single Judge of our High Court in Arun Wankhede's case (supra) is not consistent with the opinion of the Division Bench in the case reported in Premier Automobiles Ltd. (supra) or the other two decisions pressed into service on behalf of the Respondents in B.E.S.T. Undertaking Bombay (supra) and Tata Tea Limited (Bombay) Employees Union (supra). Those aspects can be considered at the appropriate stage.
