In Hira Ram and Anr. v. The State of Rajasthan 2004 (2) Cr.L.R. (Raj.) 1417, a Division Bench of this Court on the basis of facts and circumstances of that particular case, came to a conclusion that there is no satisfactory explanation of delay in filing the first information report. However, in the present case the delay in lodging the first information report has been explained satisfactorily. The question of delay and sufficient cause thereto depends on facts and circumstances of each case and so far as the present case is concerned the delay has been explained satisfactorily by the prosecution.
