12. It may be noted here that the learned counsel representing
the petitioner has relied upon a large number of judgments in support of
his submissions which have already been considered by this Court in
CWP-24903-2015 titled as 'Bhajneek Singh and another vs. State of
Punjab and another' decided on 22.02.2023. The relevant discussion is
contained in paragraphs 10 and 11, which are extracted as under:-
