ratio laid down by the Hon'ble Division Bench
in the case of Digvijaysinh
Mahendrasinh Gohil (supra) applies
to the present case and resultantly the petition is accepted. The
impugned communication/decision dated 29.4.2010 is hereby quashed and
set aside and the respondents are directed to consider the case of
the petitioner denovo in accordance with law as per the scheme of the
respondents within a period of three months from the date of the
receipt of this order. Accordingly, the petition is allowed. Rule
made absolute to the aforesaid extent only with no order as to costs.
