the 2nd respondent relied upon the decision of the Hon'ble
Apex Court in SADHNA CHAUDHARY VS. THE STATE OF
RAJASTHAN & ANR.5 On the same aspect, learned counsel
also relied upon the decision of the Hon'ble Apex Court in
X Vs. ARUN KUMAR C.K & ANR.6 wherein the Court held as
