The above judgment has been referred to in the judgment of the
Court in Manoj Pransukhlal Sagar (supra). It is clear from the above, as held
by the Supreme Court that it was open for a party to a suit to approach the
court even in appeal and seek relief of a decree in accordance with the
compromise.
