Having heard the learned counsel for the petitioner and without expressing any opinion on the merits of the case, including the issue of limitation, if any, the Director, Higher Education, Shiksha Sadan, Sector-5, Panchkula-respondent No.2 is directed to look into the matter, consider the grievance of the petitioner, raised vide her legal notice dated 27.5.2013 (Annexure P-4), which was supplemented by notice dated 15.7.2013 (Annexure P-5) and decide the same, keeping in view the judgment of the Hon'ble Supreme Court, passed in the case of Subrata Sen and others Vs. Union of India and others (2001) 8 SCC 71, at an early date by passing an appropriate order thereon, in accordance with law, but in any case within a period of three months from the date of receipt of a certified copy of this order.

Even in the case of Subrata Sen and others v. Union of India and others4, where a cut-off date was fixed for the purpose of applicability of revised pension scheme this Court has held that all retired employees constitute one homogeneous class and there cannot be cut-off date fixed to extend such benefits. All the above said cases which are referred to and relied on by the High Court are not relevant and cannot be pressed into service, to decide the issue which arises on the facts of this case.
