21. True the learned Special Government Pleader relied
on the judgment of this court in Chinnamma V. Secretary to
Government (1990(1)KLT 62). However, a reading of the
judgment shows that attention of this court was not drawn to
any of the aforesaid three judgments of the Apex Court.
Similar is the case dealt with by this court in MFA.No.55/06.
