Insuranace Co. Ltd. IV (2012) CPJ 733 (NC) In the present case, the complainant after voluntarily arriving at a compromise,
with the Opposite Parties, could not agitate
the same. In case she was not satisfied with the compromise, and it had been executed
under coercion, undue influence, mis-representation, she could produce evidence
in that regard. She did not produce any evidence to rebut the correctness of
the compromise.. Hence the principle of law laid down, in the aforesaid cases
decided by the Apex
Court, as
also by the National Commission is fully applicable to the present case. As
such, the complaint is liable to be dismissed being not maintainable.
