In the case of Old village Industries Ltd. v. Assistant Provident
Fund, Commissioner, Employees' Provident Fund Organization and
another reported in 2005 (3) LLN 572 relying upon order passed in the
case of Arihant threads v. Union of India passed by the Division Bench of
Punjab and Hariyana High Court, the case was disposed of by Delhi High
Court. Counsel for the petitioner has argued that the precondition regarding
deposition of 40% of the amount for hearing of the appeal.
