B.R. Mehta vs Atma Devi on 16 January, 1989
This case can be of no assistance to the learned counsel for the respondent because the Court had no occasion to consider the argument which has been raised before me. Similar is the position with regard to the decision in the case of R. C. Madan v. Atma Devi. 1986 (Sup.) R.C.R. 510 where again a similar order was passed but without any discussion.
