(i) In the case of State Bank of India v. Amritsar
Engineering Works & Ors. (supra) the learned Judge not
only condoned the delay in filing of application under O.22
R.4 of the code for bringing on record the legal heirs of the
deceased but also pointed out that where liability of the
defendant was joint and several, the suit will not abate if
one defendant died and his LR's were not brought on
record in time.
