12. On the question of imposition of penalty in cases where the delay in
registration is not attributable to the executants of a document, in
Shushilaben Pravinbhai Thakkar v. Sub-Registrar [AIR 2004 Guj 121],
the Court set aside the penalty imposed, and observed as under:
