6.2 Considering the decision of the Hon'ble Apex Court in the case
of Jasbir Kaur and Others (supra), and the decision of this Court
in the cases of (i) Karsanbhai Virjibhai Ramani (supra), (ii) Patel
Alpaben Yogeshkumar (supra), and (iii) First Appeal No.1860 of
2016 dated 01.08.2024, the Tribunal has committed error in
considering the income of the deceased, as the deceased was doing
driving and agriculture work, and was holding the agricultural land
in the year 2003, and thereby, earning Rs.4,000/-. Hence, monthly
income of the injured Rs.4,000/- is required to be considered.
