31. We may also note the view taken by another Division Bench of this
Court, of which one of us, (G. S. Sistani, J.) was a member in the case
of Jagbir Singh and Others vs. State reported at 2016 SCC Online
Del 2722, wherein the injuries were inflicted with the ice-pick. The
conviction of the accused persons was modified from Section 302 to
Crl. A. 1644/2013 Page 19 of 29
Section 304 Part I of IPC and were sentenced for a period of eight
