20. It is relevant to note that in matters involving
a case and a counter case, it is always desirable that both
the cases are tried by one and the same court in order to

ascertain who is the aggressor in a scuffle involving two
groups. The manner in which the trial has to be held has
been dealt in detail in the case reported in the case of
K.M.Ganesh v. State of Karnataka5. In this decision,
the meaning of simultaneous trial has been elaborately
discussed by the Single Bench of this Court.
