In view of the fact that there has been no recital or consideration of the said aspect, the order dated 06.01.2023 passed by the Additional Chief Judicial Magistrate, Kasia, Kushinagar in Complaint Case No. 6075 of 2022 (Lallan Chaudhary v. Sudhir Rao) as well as the order dated 03.10.2024 passed by Additional Sessions Judge/ FTC-II at Padrauna, Kushinagar in Criminal Revision No.64 of 2024 (Sudhir Rao v. State of U.P. and another) are set aside.
