In the case reported in (1995) 1 BLJR 678 Akhilanand Pandey v. Ranchi University it was inter alia held that in the absence of sanctioned posts no appointment can be made and if such appointments are made in violation of the mandatory provisions of the statute, they are nullity and cannot be encouraged by the Court. It was also said that writ jurisdiction should not be exercised if it would result in restoration or revival or perpetuation (sic) illegality.
