As we have mentioned above, the point is squarely covered by the Division Bench decision of our own Court in Apollo Tyres (supra). In the Allahabad High Court decision, there is no detailed discussion of the provisions contained in the Explanation to Section 87(m). Since the Allahabad High Court decision does not contain a detailed reasoning and since the point of law is covered by the decision of our own High Court, we cannot rely upon the decision of the Allahabad High Court in the name of uniformity and consistency in application of provisions of Central Act.
