It is unnecessary for us to delve further on this aspect, and we shall proceed on the premise that the judgement in "GANGOTRI" is not per Page 17 of 71 Order in IA No. 599 of 2022 in Appeal No. 188 of 2022 incuriam on the contentions raised in these proceedings.
