Therefore, as per the observations of the Hon'ble Division Bench in Shashi Kala Vyas (supra), the matter could be proceeded on the principle that contributory negligence of a passenger travelling on the roof of the bus is not ruled out altogether. However, the Hon'ble Division Bench has not laid down any fixed formula that in such cases, the proportion of contributory negligence would be invariably 25%. This Court is of the view that the proportion of contributory negligence in such a case would definitely depend on several of the facts and factors including the circumstances in which the passenger had been travelling on the roof of the bus, as also the cause of accident and the manner in which it occurred.

So far as the quantum of compensation is concerned, the learned counsel for the appellants argued that as the deceased was sitting on the roof of the bus on his volition, therefore, the appellants are not responsible to pay any damages. On the contrary, the learned Tribunal while deciding the issue No. 3 held that the fact that the deceased Ashok Kumar was travelling on the roof of the bus without the permission of the driver or the conductor has not been proved, therefore, the learned Tribunal decided the issue No. 3 against the appellants. The learned counsel for the appellants also argued that in such cases where a person chooses to travel on the roof of the bus, there is also contributory negligence on the part of that person, therefore, he argued that 25% contributory negligence of the deceased may also be determined and accordingly the compensation amount of Rs.1,07,000/- may be re- determined. It is now not in dispute that the deceased Umrav was travelling on the roof top of the bus and in view of the law laid down by this Court in the case of Hussain and Smt. Shashi Kala (supra), the contributory negligence of the passenger, who travels on the roof top, irrespective of the fact whether he had obtained a ticket or was a gratuitous passenger, is taken as 25%. In that view of the matter, the compensation awarded to the claimants needs to be reduced by 25%.
