As identical questions of law and facts are involved, therefore, I propose to decide the indicated writ petitions, by virtue of this common judgment, in order to avoid the repetition. However, the facts, which need a necessary C.W.P.Nos.4906, 4909 & 12479 of 1992 2 mention for the limited purpose of deciding the core controversy involved in the instant writ petitions, have been extracted from (1) CWP No.4906 of 1992 titled as "General Manager, Punjab Roadways, Amritsar and another Vs. Surjit Singh and another" in this respect.

Counsel   for   the   appellant   has,   however,   relied   upon   the   judgment  rendered   in   the   case   of  Pepsu   Road   Transport   Corpn.,   Patiala  through its General Manager Vs. Kulwant Kaur and Ors. reported in  2009   (4)   SCC   32  in   respect   of   compensation   arising   out   of   Motor  Vehicles  Act,  1988,  where  the   Hon'ble  Supreme  Court  has  held  that  Section   140   of   the   Motor   Vehicles   Act,   1988   which   raised   the  compensation   to   Rs.   50,000/­   under   no   fault   liability   could   not   be  made retrospectively applicable to enhance the amount payable under  Motor  Vehicles   Act,   1939   since   repealed,   as   the   accident   had   taken  place before coming into force of the new Act.   Further reliance has  been   placed   upon   the  judgment   rendered   in   the   case   of  State  Government   Pensioner's  Association   and   others   ­vs.  State   of   Bihar  reported in  (1986) 3 SCC 501,  where it was held that the benefit of  revised   gratuity   was   payable   with   prospective   effect   from   specified  date   and   can   by   no   stretch   of   imagination   be   made   retrospectively  applicable.    Therefore   fixation  of   a  cut   off  date   was  not  violative   of  Article   14   of   the   Constitution   of   India.       Further   reliance   has   been  placed   upon   judgments   rendered   by   Patna   High   Court   reported   in  (1997) 1 BLJR 188 and (1996) 2 PLJR 329 on the application of Motor  Vehicles   Act,   1988   specifically   Section   140   which   are   prospective   in  nature.

This revision petition is covered in favour of the petitioner- State by the judgment dated 23.10.2008 passed by this Court in CR No. 71 of 1997, titled General Manager, Punjab Roadways versus Surjit Singh wherein earlier judgment of this Court in General Manager, Punjab Roadways, Nawanshahar versus Gurdev Singh, 2007(4) PLR 392 as well as judgment of Hon'ble Supreme Court in State of Punjab versus Baldev Singh, 1999(1) SCT 536 were also relied on. Accordingly, the instant revision petition is allowed and impugned judgment of the Authority Civil Revision No. 63 of 1997 -2- under the Payment of Wages Act as well as impugned judgment of the appellate court are set aside.
