This judgment has been subsequently overruled by the Division Bench of this Court in Faquira and Ors. v. Khem Chand and Ors., (1999-2)122 P.L.R. 65, wherein it has been held that in a suit under Section 77 of the Tenancy Act, a tenant can be ejected on any grounds mentioned in Section 9 of the Land Tenures Act.
