He further submitted that the defendant had also moved an application (56-Ga) on 2nd September, 2000 seeking permission of the Court to deposit the rent but the said application remained pending and thereafter he again moved an application (75-Ga) on 10th January, 2007 for depositing the rent and, therefore, in such circumstances the application filed by the plaintiff-landlord under Order XV Rule 5 CPC should not have been allowed.
