12. Tajammul Ali v. Musood Ali (1910) 5 IC 776 and Qamar Hasan v. Abas Ali AIR 1924 Pat 594 are cases in which the Collector overruling an objection to the effect that there was a previous partition Under Section 7 of the Act had ordered a partition and such order had been confirmed by the superior revenue authorities and thereafter the orders of the revenue authorities were challenged in the civil Courts. What is relied upon in these eases is the fact that the suits were maintained.
