13. The above being the position, the determination as made in the Vikam Chand Khothari v. Upendra Nath Sarkar, and those in the case of Rajputana Trading Co. (P) Ltd v. Rawatmal Bhairudan, , which were cited by Mr. Roy Chowdhury, in my view, would not also have any application in this case.
