16. The learned counsel for the 1st respondent/claimant further
submitted that a Division Bench of this court in Reliance General
Insurance Company Limited Vs. Kaleeshwari and Others,
[C.M.A.Nos.1635& 1728 of 2015] vide its order dated 15.07.2019,
distinguished the above decision of the Hon’ble Supreme Court and held
that the driver of the container lorry was guilty of negligence for having
applied sudden brake.
