In this respect, we may refer to the decision of Allahabad High Court in Narain Das v. Musammat Dhania (1915) I.L.R. 88 All. 154, In that case, one Musammat Dhania and others executed a sale-deed in favour of Suraj Bhan, a minor. The executants i.e. the vendors refused to get the sale-deed registered, but it was compulsorily registered by the order of the District Registrar. Suraj Bhan then sued to recover possession of the property sold, expressing his willingness to pay the unpaid consideration. The trial Court, as well as the first appellate Court dismissed the suit, treating it as one for specific performance.
