2. The proposition canvassed for assailing the
impugned orders of penalty by the learned counsel for

the petitioner is supported by a decision of this court in
Kasim Ali Khan Vs. The State of Karnataka and
others, [ILR 1997 KAR 3092]. In the said decision, a
co-ordinate Bench of this court observed that having
decided to hold an enquiry under Regulation 23 of the
Karnataka State Road Transport Corporation Servants
(Conduct and Discipline) Regulations, 1971
("Regulations", for short) in exercise of his option under
Clause (b) of sub-regulation (1) of Regulation 22, it was
no longer open to the disciplinary authority to go back
on that decision and to revert to the power that
otherwise avails to him under Regulation 23.
