It is argued that in Uppal Housing (supra), the Co-ordinate Bench has clearly held that the provisions of section 30 of the EPH Act operate only when consolidating proceedings are pending; and since no cogent material had been brought on record in those proceedings to establish that consolidation had not attained finality in relation to Village Chandanhula, the invocation of section 30 was misplaced.

A Co-ordinate Bench of this Court, while noting in detail the initiation of process for consolidation, observed that respondent No.3 acquired right and title in the property by virtue of sale deed(s) executed in its favour by individual land holder(s) from 07.10.2005 onwards.
