In -- 'Gajraj Tewari v. Bhagirathi Pande', AIR 1924 All 95 (B) Daniels, J. held that where a joint decree had been given in favour of the respondents, the entire appeal would fail if the appellant failed to bring the legal representatives of the deceased respondent on the record. In this case two of the plaintiffs, who had obtained a joint decree for a declaration that they were the owners and in possession of certain plots, died and their legal representatives were not brought on the record in the appeal which had been filed by the defendants against whom the joint decree had been obtained.
