12. Further it has come during cross examination of PW1 that there was an iron over bridge where the accident took place. However as FIR No. 420/11 State Vs Ravi Verma Page No. -5- of 5 per the witness, she could not take the stairs as she is suffering from heart problem. Therefore, it is clear that witness had opted not to cross the road by the over bridge specifically provided for the purpose due to her medical condition. The accused, in my view could not have anticipated that a pedestrian would not use the over bridge specifically meant for the purpose and instead take the risk of using the road for crossing purpose due to her medical condition. Therefore, no fault can be attributed to accused on this count.

5. This Court has gone through the application moved on behalf of revisionists u/s 5 of Limitation Act. There are two specific grounds raised in the said application, one, that revisionists wanted to address their grievance on the next date of hearing in main case titled 'State vs. Ravi Verma', and second, that revisionists approached their previous counsel for return of the file and engage the present counsel who took three months to prepare and file the present revision petition. Revisionists have also raised the ground of financial constraints for filing the present petition by delay.

1.    Aggrieved   by   the   order   dated   28.06.2016   passed   by  Ld.   MM (West)/Delhi in a case bearing FIR No.50/2010 PS Nangloi U/s 408 IPC titled   as   State   Vs.   Ravi   Kumar   Verma,   whereby   Ld.   Trial   Court   had directed to frame charge against the accused (revisionist herein) U/s 408   IPC   and   subsequently   charge   was   framed   on   05.08.2016,   the revisionist   has   preferred   the   present   revision   petition   on   23.09.2016 interalia   praying   for   setting   aside   the   impugned   order,   thereby discharging him from the instant case.
