LTD.) that the accident occurred only in a public place that even if there was a slight violation, the Insurance Company was liable to make the payment. The Tribunal held that the Insurance Company could not exonerate itself by referring to the terms and conditions and that the Insurance Company was liable to pay the compensation to the unfortunate victims; that on some excuses stated, the Insurance Company, as such, could not escape from its liability as per the terms of the policy; consequently, the appellant was liable to pay the compensation. The Tribunal also noted that the fourth respondent had paid the necessary premium on the policy taken.
