54. Ld. Counsel for the respondent relied upon the judgment of Calcutta High
Court titled as Smt. Aloybala Ghosh vs. Goutam Sen & Ors. CO no. 1477 of
2017 decided on 17.01.2019 with respect to burden of proof, on the contrary, the
petitioner has relied upon Dhanna Lal Vs. Kalawati Bai and Ors. AIR 2002
Supreme Court 2572 wherein it was held that "The requirement of the landlord is
presumed to be bonafide unless the contrary is proved, that is to say, the burden
of proof is placed on the tenant to rebut the case of the landlord contrary to the
ARC.
