13. Under Rule 170 of the Delhi Land Reform Rules before finalising a demarcation the objector must be given an opportunity to lead evidence. That has been explained by this Court to be mandatory in the decision in Anil Sagar v. Gaon Sabha Village and Ors. . On the strength of this decision, the petitioner rightly contends that in the instant case the demarcation cannot stand scrutiny in law since the petitioner has been denied an opportunity of leading evidence.

The said report wherein no opportunity was given to one of  the effected party cannot  be  relied  upon. The  said  report thus  also  ignores  the  mandate New Case No. 7531/16 (old case no. 296/09/92)  Page No. 10/21 provided   under   Rule   170   of   Delhi   Land   Reform   Rules   as   well   as principles of Natural Justice.  The chairman of the Board was not acting as representative of DDA but as Court Commissioner hence the other affected party's view should have been considered before finalization of report.     To   support   this   view   I   am   guided   by  Anil   Sagar   Vs.   Gaon Sabha and ors., 84 2000 DLT 212.

Delhi Development Authority vs Kanwar Singh (Deceased) Thr Lrs & Ors on 7 April, 2021

Learned counsel for the Appellant submits that the learned Trial Court has erred in not appreciating that at the time of conducting the demarcation, the Tehsildar did not have the appropriate record such as field book, masavi and shajra plan and the demarcation was done without taking the three pucca points. The Tehsildar wrongly rendered the report by observing that the Respondents are in possession of the suit property since the time of their forefather without any evidence to that effect and even the demarcation report was not exhibited as per law. The Tehsildar never stepped into the witness box and therefore, was not even put to cross-examination. It is also argued that under Rule 170 of the Delhi Land Reforms Rules before finalizing the demarcation, the objector must be given an opportunity to lead evidence as held by this Court in Anil Sagar vs. Gaon Sabha and Ors., (2000) 84 DLT 212.
