The Kerala High Court noticed the decision of the Delhi High Court in H.L. Sethi (supra) and observing that it was in agreement with the decision held that the classification excluding employees who were on leave preparatory to retirement from the pension benefit is a reasonable classification and it cannot be termed as arbitrary on unconstitutional, rejected the claim.
