In SH Lalsangzuala (supra) and Suraj Gupta (supra), this
Court, for the failure of the learned trial Court to put
incriminating evidence to the accused in his examination under
section 313 CrPC, had set aside the conviction and sentence and
had remanded the case to the learned trial Court for fresh
consideration after examining the accused in accordance with law.
