6. The connected and the identical matter in Criminal Writ No. 13 of 1980 (Jaimal Singh and Anr. v, State of Punjab), had come up before me sitting singly. Therein inter alia, an objection was raised to the very maintainability of a writ of habeas corpus, on the ground that it could be directed only against a flagrantly illegal detention plainly violative of the law and not against an imprisonment by warrant of the judgment of the criminal court which has achieved finality. Considering the significance of the issue, the matter was. referred to a Division Bench. Beeper it. reliance was placed primarily on the judgment in Criminal Writ Petn.
