35. My decision in this regard finds support by
principles of law laid down in case of Papatla John
Veeranna v. State of A. P. & Anr., 2003 Cri. L.J. 2204,
wherein the Andhra Pradesh High Court observed that the
incident had taken place on 08.02.1998, whereas the
complaint was submitted on 06.03.1998. The delay of one
month was hardly explained. The time between the alleged
date of occurrence and submission of complaint was so
vast that it was possible to mediate or invent anything.
When delay of two days was held to be fatal by the
Supreme Court, it was just impossible to prosecute a
person on the basis of a complaint submitted almost one
month after the alleged date of commission of offence.
