In view of the above, applying the ratio in the case of Oriental Insurance Co. Ltd. (supra) and the fact that the appellant- insurance company has not filed its policy that it was contractually not liable to pay penalty, it is held that the appellant was liable to pay penalty, and the appeal is therefore dismissed, leaving the parties to bear their own costs.
