28. We have meticulously gone through the impugned order dated
11.05.2023 as passed by the said Tribunal. It appears to us that the said
Tribunal most mechanically placed its reliance upon its previous order dated
24.03.2022 as passed in OA 1594 of 2017 (Jayanti Chatterjee Vs. Union of
India and Ors.) which in considered view of this court are factually different

from the facts and circumstances as involved in the original application as
disposed by it.
