Himachal Pradesh Administration vs Shri Om Prakash on 7 December, 1971

The Supreme Court declined to accept Mr.Gopal Subramanium's submission by placing strong reliance upon the judgment of the Privy Council in Pullurkuri Kotayya vs. King Emperor [AIR 1947 PC 67] and the judgment of the Supreme Court in Himachal Pradesh Administration vs. Om Prakash [(1972) 1 SCC 249] and held that the police confession can be used only for the discovery of a hitherto unknown fact and nothing else.
