On meaningful understanding of the said decision and
the definition clause, it is crystal clear that, the
Disciplinary Proceedings cannot be initiated and
proceeded against the retired Government Servants
under the said rules, as rightly contended by the
learned counsel for the petitioner, in as much as in
these rules, the present tense is used sofar as the
Government Servants are concerned. Therefore, we
have consider the provision under Rule 214 of the said
Rules, to know as to whether the rule is applicable or
not to the facts of this case.
