Ashoka Marketing (supra) and Nusli Nivelli Wadia ( Supra were relied upon
in a later Division Bench decision of Calcutta High Court in The Board of
Trustees for the Port of Kolkatta and another Vs. Vijay Kumar Arya and
others. MAT No. 2847/2007 and CAN No.10053/2007- decided on
02.02.2009 ( MANU/WB/0025/2009) and while holding that an
instrumentality of the State has to act reasonably, it was observed as under:-
