This must now be taken to be the settled law in view of a rather recent decision of a three-Judge Bench of the Supreme Court in Nanakram v. Kundalrai , which has approved an earlier two-Judge Bench decision of the Supreme Court in Murlidhar v. State of Uttar Pradesh .
