3. The learned counsel appearing on behalf of the petitioners has
relied upon the judgement of the Hon'ble Supreme Court in New Horizons
Limited and another Vs Union of India and others, 1995(1) SCC 478 and
in particular paragraph 23 thereof which reads as under:-
