14.At the outset, it can be said that the issue to be decided has
to be gone into detail upon analyzing the decisions cited by both
counsels. With due respect, I can say that the decision of the Hon'ble
Apex Court in Mastan case (cited supra) (2005-2-TNMAC (SC) 264 is
not applicable to the case on hand.
