In R. Ayyavu v. Gopinathan Nair, 1991 ACJ 718, while dealing with the principle of assessment of quantum of damages in a fatal accident case involving the death of a child aged five years, the items of compensation classified were, for pain and suffering undergone by the child before the death, loss of expectation of life, pecuniary loss by adopting the multiplier method and accordingly Rs.48,000/- was awarded as a whole, taking into consideration the fact that the amended Act has fixed Rs.25,000/- as the minimum compensation in all cases of death of a human being, whether
an adult or a child, man or woman.
